RESOLUTION NO. 08-228 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING THE PLACEMENT ON THE NOVEMBER 4, 2008 GENERAL ELECTION THE CITY COUNCIL SPONSORED PLEASANTON RIDGELINES PROTECTION AND GROWTH CONTROL INITIATIVE, AUTHORIZING DIRECT AND REBUTTAL ARGUMENTS CONCERNING THE INITIATIVE MEASURE AND SETTING SUBMISSION DEADLINES, DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS, MAKING DETERMINATIONS REGARDING COUNCIL- WRITTEN ARGUMENTS, AND REQUESTING THE ALAMEDA COUNTY REGISTRAR'S OFFICE TO CONSOLIDATE THIS ELECTION WITH THE NOVEMBER 4, 2008 GENERAL ELECTION WHEREAS, California Elections Code §9222 permits the City Council to submit to the voters a proposition for the repeal, amendment or enactment of an ordinance; and WHEREAS, the City Council has reviewed and considered the Pleasanton Ridgelines Protection and Growth Control Initiative measure attached to this resolution as Exhibit A; and WHEREAS, the Pleasanton Ridgelines Protection and Growth Control Initiative measure reaffirms and readopts/adopts existing General Plan policies and programs, and therefore no additional environmental review is required to place this initiative measure on the ballot; and WHEREAS, California Elections Code §9282 specifies that the legislative body, or any member or members of the legislative body authorized by that body, may file a written argument for any City measure; and WHEREAS, California Elections Code §9285 sets forth the procedures for rebuttal arguments; and WHEREAS, California Elections Code §9280 specifies that the City Council may direct the City Clerk to transmit a copy of the initiative measure to the City Attorney to prepare an impartial analysis thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the City Council sponsored Pleasanton Ridgelines Protection and Growth Control Initiative measure, attached to this resolution as Exhibit A, be placed on the November 4, 2008 General Election ballot, with the initiative measure to be designated by letter by the Alameda County Registrar. Section 2. That the ballot language for the initiative measure shall be as follows: Shall the Pleasanton Ridgelines Protection and Growth YES Control Initiative be adopted, that would preserve scenic hillsides and ridges surrounding Pleasanton, and affirm and implement policies that protect hillsides and define housing NO units that respects the voter-approved housing cap?
