WHEN RECORDED, RETURN TO: <br /> <br />HACIENDA BUSINESS PARK <br />OWNERS' ASSOCIATION <br /> 4637 Chabot Drive, Suite 200 o' <br /> Pleasanton, CA 94566 <br /> <br /> GRANT OF EASEMENT <br /> FOR METAL ARCHES <br /> <br /> Grantor, CITY OF PLEASANTON, a municipal corporation <br />("City"), hereby grants to HACIENDA BUSINESS PARK OWNERS <br />ASSOCIATION, a California nonprofit corporation (hereinafter <br />"Hacienda"), an easement for fifty (50) years, renewable for <br />periods of ten (10) years upon Hacienda's written request and <br />approval by the City Council, to construct, maintain, install, <br />inspect, and reconstruct four (4) metal arches on, above, <br />abutting and under City's real property (hereinafter the "subject <br />premises") described in Exhibit "A" attached hereto and <br />incorporated herein by this reference. <br /> <br /> This easement for metal arches is granted subject to the <br />following terms and conditions: <br /> <br /> 1. Improvement. Hacienda shall maintain, keep in repair, <br />and/or reconstruct as necessary, as further provided herein, the <br />metal arch structures as constructed on the real property <br />described in Exhibit "A". <br /> <br /> 2. Property Usage. The use of the above-described property <br />by Hacienda shall be limited solely to metal arch structures and <br />related uses as set forth in the Grant of Easement. <br /> <br /> 3. Improvement Compliance. The said metal arch structures <br />and related uses shall be maintained, repaired, and/or <br />reconstructed in conformance with all applicable laws, statutes, <br />ordinances, rules and regulations, and said maintenance, repair, <br />and/or reconstruction shall be performed to the satisfaction of <br />the City of Pleasanton. <br /> <br /> 4. Cost of Maintenance. The maintenance, repair, and/or <br />reconstruction of said metal arch structures and related uses <br />shall be at the sole cost and expense of Hacienda, except traffic <br />signals which shall be maintained by City. Hacienda shall <br />maintain said metal arch structures in a state of good repair and <br />in a neat and attractive condition, likewise at its own cost and <br />expense. <br /> <br /> 5. Manner of Maintenance. Hacienda shall carefully <br />maintain, repair, and/or reconstruct said metal arch structures <br />in such manner as not to damage, interfere with, or obstruct the <br />use of City-owned real property not included in this Grant of <br />Easement adjacent to, under, and abutting the subject premises. <br />The City or its agents shall be permitted to maintain, repair, or <br /> <br /> - 1 - <br /> <br /> <br />
