PLANNING C0~4iISSION <br />Pleasanton, California <br />RESOLUTION N0. 978 <br />WHEREAS, the Planning Commission did, on December 10, 1969, <br />by Resolution No. 971, recoameend to the City Council <br />that RZ-69-24 be approved and did, by Resolution No. 972, <br />grant to James D. Stacy a conditional use permit as <br />requested in UP-69-12 with respect to property des- <br />cribed is City Council Resolution No. 69-248, subject <br />to conditions as therein provided for, among which <br />wan the requirement that the grantee of said permit <br />relinquish any claim he may have in any conditional <br />use permit applicable to as adjoining parcel of land <br />.commonly referred to as the "Overpack Parcel," and <br />which is more particularly described in an agreement <br />between the Cfty of Pleasanton and A. Glen Overpack, <br />dated January 20, 1964; and <br />WHEREAS, on December 24, 1969, a petition was filed on behalf <br />of A. Glen Overpack, requesting that the Planning <br />Commission reconsider its action taken on December 10, <br />19b9, pursuant to Resolution No. 972; and <br />WHEREAS, on December 24, 1969, an appeal to the City Council <br />from the action taken by the Pla naing Commission by <br />Resolution No. 972 was filed on behalf of A. Glen <br />Overpack; and <br />WHEREAS, the petition for reconsideration herein was con- <br />sidered by the Planning Coamission at its meeting <br />January 14, 1970, and oral and documentary evidence <br />heard; and <br />WHEREAS, it appears desirable that the Planning Commission <br />attempt to clarify the status of the land use controls <br />on the two parcels herein. <br />NOW, THEREFORE aE IT RESOLVED AS FOLLOWS: <br />1. That the granting of UP-69-12 pursuant to Planning <br />Commission Resolution No. 972 be affirmed and that, <br />with respect to the relinquishment requirement therein <br />referred to, the grantee of said permit be required <br />to comply therewith in writing on a form approved by <br />the City Attorney. <br />2. That the conditional use permit granted A. Glen <br />Overpack on November 21, 1967, pursuant to Planning <br />Commission Resolution No. 730, be reinstated in the <br />name of A. Glen Overpack subject to the following <br />conditions: <br />(a) That said permit be subjected to the <br />one year lapse provision contained in <br />Sec.24.108(a) of Ordinance No.520, from and <br />after the time that title to the parcel to <br />which Planning Commission Resolution No.730 <br />applied is revested nr.qufeted in A. Glen <br />Overpack. <br />
