On November 5, 1985, City approved a Planned <br />Unit Development ("PUD-85-10") for Hopyard Center, by <br />Ordinance No. 1227. PUD-85-10 makes development of the <br />Hopyard Center as described therein contingent upon receipt <br />of legal assurances that Hopyard will construct an automo- <br />bile parking structure ("Parking Facility") providing <br />certain parking spaces over the Pleasanton Canal on property <br />adjacent to Hopyard Center. <br /> <br /> C. City owns and proposes to acquire interests in <br />the Pleasanton Canal ("Canal Area") easterly of Hopyard Road <br />and adjacent to Hopyard Center. The Canal Area is further <br />described on Exhibit 2, attached hereto. Hopyard now <br />desires to grant to City an access easement to the Parking <br />Facility and to the Canal Area, in, on, under, over and <br />along a portion of Hopyard Center, as described below. <br /> <br /> NOW T~EEREFORE, IN CONSIDERATION of the mutual <br />covenants and promises of the parties, the parties agree as <br />follows: <br /> <br /> 1. Easement. Hopyard hereby grants to City a <br />non-exclusive easement of access ("Easement") in, on, under, <br />over and along a twenty-four feet (24') wide strip of <br />Hopyard Center ("Hopyard Easement Area"), connecting from <br />Hopyard Road to the Parking Facility.
