inure to the benefit of, and be binding upon, the successors <br /> and assigns of the parties hereto. <br /> <br /> 8. Public Utility Easements. If any public <br />utility company requires an easement, right of entry or <br />other interest in the Easement Area in order to provide <br />utility service to Hopyard Center and to the Easement Area, <br />City and Hopyard shall execute the document(s) necessary to <br />convey a necessary interest, provided that the conveyance <br />does not materially affect Hopyard's use of Hopyard Center <br />or the Easement Area. <br /> <br /> 9. Attorney's Fees. If either party brings an <br />action in law or in equity to enforce, interpret or redress <br />a breach of this Grant of Easement, the prevailing party in <br />such action shall be entitled to reasonable attorneys' fees <br />and costs incurred in addition to all other relief allowed <br />by law. <br /> <br /> 10. Exhibits. Exhibits ~, ~ and ~ are hereby <br />incorporated herein by this reference. <br /> <br /> 11. Counterparts. This Grant of Easement may be <br />executed in any number of counterparts with the same effect <br />as if all parties hereto had signed the same document.
