("Parking Facility") in the approximate configuration shown <br />on Exhibit 3, attached hereto. <br /> <br /> 2. Appurtenant. The Easement shall be appur- <br />tenant to Hopyard Center and shall run to the benefit of <br />Hopyard, Hopyard's successors, assigns, lessees, licensees, <br />permittees, and patrons of the Hopyard Center. <br /> <br /> 3. Use. The Easement may be used by Hopyard and <br />Hopyard's successors, assigns, lessees, licensees, per- <br />mitees, and by occupants and patrons of Hopyard Center for <br />parking purposes incidental to use of Hopyard Center. <br /> <br /> 4. Duration. The Easement is perpetual and shall <br />not terminate or be extinguished by non-use or abandonment. <br /> <br /> 5. Structures. Hopyard shall not build or place <br />in the Canal Easement Area any permanent or temporary above- <br />ground structure other than the Parking Facility, except <br />such temporary structures as may be required for the <br />construction of the Parking Facility. <br /> <br /> 6. Lien. Hopyard shall promptly pay and dis- <br />charge all claims for labor performed, supplies furnished <br />and services rendered in connection with the construction <br />and maintenance of the Parking Facility and shall keep the <br />Easement free from all mechanics' and materialmen's liens in <br />connection therewith. <br /> <br /> 7.
