B. Once a building permit is issued, its time of expira- <br />tion shall be controlled by Uniform Building Code Standards. In <br />the event of expiration of a building permit, any fees or consid- <br />eration paid pursuant to this Agreement shall not be refundable. <br /> <br /> C. Upon expiration of the Growth Management approval or <br />building permit issued pursuant to the Growth Management ap- <br />proval, the approval shall be terminated as to the Developer and <br />the City will reallocate those units in accordance with the <br />Growth Management plan. <br /> <br /> D. The expiration of Growth Management approval as to a <br />unit or units authorized for a specific year shall not be con- <br />sidered a breach of this Agreement by the Developer and shall in <br />no way affect the validity of a Growth Management a43proval for <br />subsequent years. <br /> <br />IV. CONTRIBUTIONS <br /> <br /> A. Existing Fees <br /> <br /> Developer agrees to pay the City fees in effect at the time <br />each building permit is issued, including any school impact fee <br />which may then be in force. <br /> <br /> -5- <br /> <br /> <br />
