prohibiting the locking of these gates. The gates are <br />necessary for proper fire access to the rear of these <br />units. The City shall be named as beneficiary of the <br />CC&RS and granted the power to enforce its provisions <br />if the homeowners association fails to do so. <br />5. That there shall be a fence completely around the pool <br />area meeting Pleasanton Ordinance Code requirements. <br />6. That the minimum setback of patio fences along Black <br />Avenue shall be 15 ft. and that the maximum height of <br />these fences shall be 5 ft. this may be accomplished <br />by moving entire project a maximum of 5 ft. to the <br />north thereby leaving a minimum 25 ft. rear yard. <br />7. That the developer acknowledges that the City of <br />Pleasanton does not guarantee the availability of <br />sewer capacity to serve this development by approval <br />of this project and that the developer agrees and <br />acknowledges that building permit approval may be <br />withheld if sewer capacity is found by the City not <br />to be available. <br />8. That the developer be aware that RAP approval is <br />required prior to the subdivision of the property <br />or issuance of building permits. <br />9. That the street number of the buildings be posted so <br />as to be easily seen from the street at all times, day <br />and night. <br />10. That all ducts, meters, air conditioning equipment, and <br />any other mechanical equipment, whether on the structure, <br />on the ground, or elsewhere, be effectively screened <br />from view with materials architecturally compatible <br />with the main structure. <br />11. That all mechanical equipment be constructed in such a <br />manner that noise emanating from it will not be per- <br />ceptible at or beyond the property plane of the subject <br />property in a normal environment for that zoning district. <br />,~2. That all lighting be constructed in such a manner that <br />,glary is directed away from surrounding ~rope~ties and <br />rights-of-way. <br />13. That all trash and refuse be contained completely within <br />enclosures architecturally compatible with the main <br />structure. <br />14. That all trees used in landscaping be a minimum of <br />15 gallons in size and all shrubs a minimum of <br />5 gallons. <br />-2- <br />
