Box 520 <br /> Pleasanton, CA 94566 <br /> <br /> LAND EXCHANGE AGREEMENT <br /> (ZONE 7, CITY) <br /> <br /> THIS LAND EXCHANGE AGREEMENT ("Agreement") is entered into <br />this day of July, 1986, by and between the CITY OF <br />PLEASANTON, a municipal corporation ("City"), and the ALAMEDA <br />COUNTY FLOOD CONTROL AND WATER CON8ERVATION DISTRICT, ZONE 7 <br />("Zone 7"). <br /> <br /> RECITALS <br /> <br /> A. Zone 7 desires improved access and working area to the <br />Line G-l-1 Flood Control Channel ("G-l-1 Channel") (APN <br />941-1302-2-18) in the vicinity of the Dublin-San Ramon Services <br />District wastewater treatment plant and Johnson Drive in the City <br />of Pleasantono <br /> <br /> B. The City desires to create a public parking lot over the <br />Pleasanton Canal between the Pleasanton Sports and Recreation <br />Park and the Hopyard Village Shopping Center. The City also <br />desires to obtain an easement in gross across the G-l-1 Channel. <br /> <br /> C. The parties acknowledge that a portion of the property <br />involved in this land exchange is currently the subject of <br />litigation. The City and Alameda County are codefendants in the <br />case of Charles Campbell v. Terisita Lauigan, Acting Tax <br />Collector of Alameda County, et al. in the Superior Court, County <br />of Alameda, Case No. 608335-5. The subject matter of the <br />litigation is a thirteen acre parcel adjacent to the Zone 7 G-l-1 <br />Channel (APN 941-1302-2-19) deeded to City by Alameda County in a <br />tax deed sale. A portion of the seven foot strip of land <br />adjacent to the G-l-1 Channel which City will convey to Zone 7 <br />pursuant to Section 1 of this Agreement (i.e. a portion of Parcel <br />A-l) is located within APN 941-1302-2-19. Zone 7 desires to <br />proceed with this exchange despite the contingencies arising from <br />the fact of this litigation. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and <br />promises of the parties, the parties hereto agree as follows: <br /> <br /> 1. City Conveyance of 7 Ft. Strip Along G-l-1 Channel. <br />City shall quitclaim to Zone 7 all of its right, title and <br />interest in that certain real property consisting of 0.428 acres <br />(18,648 square feet) and described in Exhibit "A-i" ("Parcel A-i" <br />also designated as "R/W No. 7567"). The City's deed of <br />conveyance may reserve a 64 ft. transverse right-of-way easement <br />for road purposes at a location to be specified by the City <br /> <br /> - 1 - <br /> <br /> <br />
