Res. 1808 <br />Pg. 5 <br />systems are in good repair and being properly <br />maintained. The Contractor shall report all <br />problems, wear and tear on the systems, and <br />expected future service needs; and <br />c) that the City shall be named as a beneficiary <br />of said CC&RS and granted the power to enforce <br />its provisions if the Homeowners Association <br />fails to do so. <br />30. That the Homeowners Association shall enter into <br />an agreement to hold harmless, defend and indemnify <br />the City, its officers and employees from any cause <br />of action or claim for damage or injury caused by <br />the private roadways, or private utility systems, <br />or their maintenance and upkeep, or caused by the <br />party contracted with for maintenance services and <br />that the CC&Rs shall make each homeowner chargeable <br />for costs related to responsibilities provided for <br />in this condition. <br />31. That all conditions of approval of case PUD-79-2 <br />shall be listed in the CC&RS. <br />-- 32. That an erosion control plan be submitted to and <br />approved by the City as part of the improvement plan <br />for the subdivision. <br />33. That a dust control plan be submitted to and approved <br />by the City prior to the beginning of grading. <br />34. That there shall be access for emergency vehicles to all <br />open space areas shown on the development plan. <br />35. That except as modified by this development plan, the <br />site standards for all structures on the subject <br />property shall be those of the R-1-20,000 District. <br />36. That all utilities required to serve the development <br />shall be installed underground. <br />37. That the developer install street trees as required <br />per ordinance. <br />38. That the site be kept free of fire hazards from the <br />start of construction to final inspection, and <br />that the Fire Department emergency number be provided <br />adjacent to all telephones on the site. <br />
