Item 6c <br />Staff Report <br />PLANNING COMMISSION E~~18` <br />April 9, 1980 <br />SUBJECT: UP-80-6 <br />APPLICANT: Larry Miller and Chuck Peek <br />PURPOSE: Application for a conditional use permit to <br />allow the establishment and operation of a <br />sandwich shop in the industrial building <br />located at 7063 Commerce Circle. Zoning <br />for the property is I-G (General Industrial) <br />District. <br />ATTACHMENT: Location Map <br />The applicants, Larry Miller and Chuck Peek, wish to open a <br />sandwich shop in a portion of the industrial building located <br />at 7063 Commerce Circle. The establishment would be mainly for <br />the purpose of serving workers in the Commerce Circle area. <br />They state that it would be open only between 7:00 A.M. and <br />7:00 P.M. Restaurants are a conditionally allowed use in the <br />I-G District, therefore, Messrs. Miller and Peek are requesting <br />a conditional use permit for this purpose. <br />The applicants don't intend to change the building on the outside <br />in any way. The structure is approximately 18,000 sq. ft. in size <br />and the sandwich shop would occupy 1920 sq. ft. of that total. <br />There are at least 34 parking spaces on the property. The sandwich <br />shop would require 12 spaces and since there are only 14 or 15 <br />employees in the other businesses in the structure, parking <br />should be no problem. Additionally, since many of the customers <br />of the sandwich shop would walk there from other buildings, parking <br />demands should be lower than normal for a restaurant of its size. <br />Staff Recommendation: In the staff's estimation, the proposed <br />use would be appropriate for the area and all findings required <br />for the granting of the use permit could be made in this case. <br />For this reason, we recommend approval of case UP-80-6 subject <br />to the following conditions: <br />1. That this use permit is granted only for a 36 seat <br />restaurant to occupy 1920 sq. ft. of the building <br />located at 7063 Commerce Circle. <br />2. That a minimum of 12 on-site parking spaces be made <br />available to serve the restaurant at all times. <br />3. That the owner of the building at 7063 Commerce <br />Circle be aware that uses in the remainder of the <br />building shall be limited by the number of the <br />remaining parking spaces on the site and that new <br />uses shall be closely analyzed to make sure that <br />they do not exceed the remaining parking on the <br />site. <br />
