4. Landscaping. The City and Utility agree that Utility's <br />obligations to provide landscaping on its frontage on the proposed <br />Valley Avenue Extension shall be limited to Thirty Thousand Dolalrs <br />($30,000.00) upon completion.. Utility agrees to devote an average <br />of eight (8) feet of frontage to said landscaping, to a maximum <br />of thirteen thousand (13,000) square feet. The-City agrees to <br />pay any landscaping costs in excess of said thirty thousand dollars <br />($30,000.00), and to administer the contracting, design, purchase, <br />installation, and planting of the landscaping, including but <br />not limited to all plants, shrubs, trees, grass, vines, fencing <br />and irrigation system except that Utility shall bear the costs <br />and responsibility of such additional gates that may be necessary <br />for access to Valley Avenue from the Utility Property, except <br />as set forth in paragraph 5 below. Utility shall be obligated <br />to maintain said landscaping after its completion in accordance <br />with the landscaping plan from which said landscaping was provided. <br /> <br /> The City shall consult with Utility on the installation of said <br />landscaping to insure that said landscaping does not interfere <br />with the access of vehicles to and from the Property and the <br />buildings thereon. Utility agrees that the fence separating <br />its Property from Valley Avenue can be located between the landscaped <br />portion of Utility's property and the remainder of Utility's <br />property. <br /> <br /> 5. Purchase of 1630.47 Square Feet. Utility and Auburn <br />agree to sell the property referenced in Exhibit "C" hereto for <br />Four Thousand Dollars ($4,000.00) when requested by the City. <br /> <br /> 6 <br /> <br /> <br />
