AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> <br />July, 1986, by and between the CITY OF' PLEASANTON, a municipal <br />corporation (hereinafter referred to as "City"), and DELTA <br />PROPERTIES, a general partnership (hereinafter referred to as <br />"Delta"). <br /> <br /> RECITALS <br /> <br /> A. Delta is the owner in fee of a parcel of land within a <br />larger development commonly referred to as Pleasanton Park <br />Business Center located in Pleasanton, California, as shown on <br />Exhibit "A", attached hereto and by this reference incorporated <br />herein, (hereinafter "Pleasanton Park"). <br /> <br /> B. City approved a development plan for Pleasanton Park <br />Business Center designated as PUD-80-14, and subsequently <br />approved a final subdivision map designated Tract 4788. <br /> <br /> C. Delta purchased from Dublin San Ramon Services District <br />sewer connection permits which allocated sewer treatment capacity <br />for 20,000 gallons per day on November 27, 1984 (hereinafter <br />"DSRSD permit"). <br /> <br /> D. The Dublin San Ramon Services District sewer connection <br />permits granted to Delta require building permits must be <br />obtained within three (3) years of purchase of any sewer <br />connection permits, or such sewer permits shall be canceled.
