9. This a2reement does not provide for the installation by PGandE of any underground conduits and/or conductors extendinS from the Electric Facilities to any existing or proposed building within the District other than as provided in the attached plans and Specifications. The obligations of both the property owners and PGandE under PGandE's Electric Extension Rule on file with the California Public Utilities Commission (Commission), relating to extension and service installations, are not included in this agreement. 10. Any rearrangement, relocation, addition to or modification of the Electric Facilities, Electric Relocation Facilities and Street Lighting Service Facilities as shown on Exhibit "A" after commencement of construction required for any reason other than the sole convenience of PGandE shall be paid for on demand and in advance by City. 11. City shall, upon the installation of the Electric Facilities, Electric Relocation Facilities and Street Lighting Service Facilities, execute and deliver to PGandE a deed or deeds in the form attached hereto as Exhibit "B" conveying the Electric Facilities, Electric Relocation Facilities and a poartton of the Street Lighting Service Facilities to PGandE. 12. Except as provided in Section 8, City shall make payments to PGandE hereunder only from the proceeds of assessments levied and bonds sold in the assessment district proceedings. There shall be no liability upon City to make such payment from any other source of funds. PGandE shall not be obligated to proceed hereunder until sufficient funds have b~en made available and all payments to be made to PGandE have been made. 13. All Electric Facilities, Electric Relocation and a portion of the Street Lighting Service Facilities installed hereunder shall be and remain the property of PGandE. -4-
