PLANNING COMMISSION <br />_ City of Pleasanton <br />RESOLUTION NO. 1505 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />APPROVING MS-76-14. <br />WHEREAS, the executors of the Morris Stulsaft Testamentary Trust <br />have applied for a minor subdivision to subdivide approximately 60 acres <br />of land located east of the end of Arbor Drive into four approximately <br />15-acre parcels; and <br />WHEREAS, as part of this subdivision, they are requesting that <br />the underground utilities requirement of the Subdivision Ordinance be <br />waived, at least temporarily; and <br />WHEREAS, only the Planning Commission is empowered to grant such a <br />modification to the Subdivision Ordinance; and <br />WHEREAS, on March 9, 1977, the Planning Commission held a hearing on <br />this application at which they reviewed all pertinent maps, documents <br />and testimony. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission approves the minor subdivision <br />filed under MS-76-14, subject to the following conditions: <br />1. That the developer enter into a minor subdivision agreement with <br />the City prior to issuance of any building permits for any structures <br />on any of the four parcels. <br />2. That the developer submit minor subdivision improvement plans <br />to the City for review and approval. <br />3. That Arbor Drive be extended as a 50 ft. wide type B residential <br />collector public street from its existing terminus at Tract 3329, approxi- <br />mately 1,170 feet to the end of the cul-de-sac and that the developer <br />dedicate a 25 ft. wide parcel for street purposes and an associated <br />8 ft. wide public service easement. <br />4. That specific approval of the water and fire protection systems, <br />the sanitary sewer systems and the storm drainage system be withheld <br />until final design is completed on the improvement plans. <br />5. That the developer be advised that sufficient sanitary sewer <br />connections are not now available to serve the subject property; that <br />the time schedule when service would become available is uncertain (if <br />ever); that a building permit cannot be issued for construction on the <br />property until sewage treatment capacity is available or a private <br />sewage disposal system approved by the City Council; that the approval <br />of the development with a private sewage disposal system does not entitle <br />the development to any priority for a sewer connection; and that the <br />development will be on an approved private development system for an <br />unknown period of time, perhaps many years. <br />
