PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1520 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON APPROVING A CONDITIONAL USE PERMIT <br />FOR ANN WALDO FILED UNDER UP-77-6. <br />WHEREAS, an application for a conditional use permit was filed by <br />Ann Waldo to allow a dance studio to be located at 719 Main <br />Street; zoning for the property being C-C (Central Commercial) <br />District; and <br />WHEREAS, a public hearing was held on May 18, 1977, at which time all <br />pertinent maps, drawings, documents and testimony were re- <br />viewed by the Planning Commission; and <br />WHEREAS, testimony indicated that there is a conflict concerning the <br />use of a common easement serving this property and the ad- <br />jacent property at 347-351 St. Mary Street; and <br />WHEREAS, the property owner of the adjacent site on St. Mary Street <br />- expressed opposition to this use, indicating it would further <br />aggravate the parking problems presently existing; and <br />WHEREAS, after hearing testimony from the property owners of both sites <br />as well as testimony from the applicant, the Planning Com- <br />mission made the following findings: <br />1. That because of the conditions under which this Condi- <br />tional Use Permit is granted, the location of the use <br />would be in accord with the objectives of this chapter <br />and the purposes of the district in which the site is <br />located. <br />2. That because of the conditions under which this Condi- <br />tional Use Permit is granted, the use will not be detri- <br />mental to the public health, safety or welfare or mater- <br />ially injurious to the properties or improvements in the <br />vicinity, as no use will be permitted until the proper <br />agreements can be made pertaining to utilization of the <br />common easement serving the parking area for both sites. <br />3. That the proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />-1- <br />
