III. PERFECTION AND EXPIRATION OF GROWTH MANAGEMENT APPROVAL <br /> <br /> A. Growth Management approval for dwelling units approved <br />by this Agreement can be perfected by obtaining building permits <br />within the period specified in Paragraph II(B)(1). In the case <br />of ~detached single-family lot subdivisions, Growth Management <br />approval can also be perfected by the filing of a final map with <br />the County Recorder within the three year period specified in <br />Paragraph II(B)(1) for the issuance of building permits. <br /> <br /> B. Once a building permit is issued, its time of expiration <br />shall be controlled by Uniform Building Code Standards. In the <br /> <br />event of expiration of a building permit, any fees or <br />consideration paid pursuant to this Agreement shall not be <br />refundable. <br /> <br /> C. Upon expiration of the Growth Management approval or <br /> <br />building permit issued pursuant to the Growth Management <br />approval, the approval shall be terminated as to the Developer <br />and the City will reallocate those units in accordance with the <br />Growth Management plan. <br /> <br /> D. The expiration of Growth Management approval as to a <br />unit or units authorized for a specific year shall not be <br />considered a breach of this Agreement by the Developer and shall <br />in no way affect the validity of a Growth Management approval for <br />subsequent years. <br /> <br /> - 5 - <br /> <br /> <br />
