b. In general, the designated projects would be subject to <br /> existing City fees and the usual public needs fee of <br /> $750 per unit. Secause inflation has subsided, no pro- <br /> grammed increase in the public needs fee would be writ- <br /> ten into long term agreements. <br /> <br /> c. After negotiation, the long term agreement may provide <br /> for the waiver of the public needs fee in exchange for <br /> in-kind contributions of approximately equal value. <br /> <br /> d. However, where the public improvement in question is <br /> required as a condition to project approval or as a con- <br /> dition precedent to development then total contributions <br /> would be permitted to exceed the public needs fees. <br /> <br /> For example, it is anticipated that the developers of. <br /> Kottinger Ranch will agree to participate in the Valley <br /> Avenue Extension assessment district and that the extent <br /> of their contribution to the assessment district will <br /> exceed the public needs fees which are forgiven because <br /> conditions of project approval make development contin- <br /> gent upon the Valley Avenue Extension, among other <br /> things. <br /> <br />9. Apartments <br /> <br /> a. In future years, apartment projects should be given long <br /> term agreements for an additional fifty units per year <br /> (above the base of fifty units per project). A maximum <br /> of three apartment projects per year would be entitled <br /> to this allocation to avoid exceeding the General Plan <br /> goals regarding apartment construction. <br /> <br /> b. E.g. Math could work like: <br /> - Long term agreements for up to 10 <br /> projects @ 50 units each in a given year 500 units <br /> - If three of those are apartment projects <br /> then: 150 units <br /> <br /> 650 units <br /> Of which 300 units or more would be apartment units. <br /> <br /> c. Apartment projects of 200 units or less could be ap- <br /> proved for long term agreements providing a two year <br /> phased approval with an equal increment in each year. <br /> <br /> d. Apartment projects eligible for the additional fifty <br /> units per year would be those projects which have an <br /> average density of fifteen (15) units per acre or more. <br /> <br />10. The small project automatic exemption should be raised to <br /> twelve (12) units to encourage infill developments. That <br /> ordinance change should take effect this year so that the six <br /> approved small projects can all proceed this year. <br /> <br /> <br />
