(But <br /> note No. 11 below regarding Amador Valley Savings Vintage <br /> Heights project.) <br /> <br /> 2. ~Eligible projects are each programmed for 50 units maximum <br /> per year until built out (except for the one apartment proj- <br /> ect which is programmed for 100 units per year (Note No. 9, <br /> below)). <br /> <br /> 3. Shea Homes is the only Long Term Agreement providing addi- <br /> tional 1986 growth management approvals (e.g. 50 units). <br /> Note: If the 52 small project units are granted approval or <br /> exemption to build in 1986 as recommended in No. 10 below <br /> then the 1986 approvals will total 1,050. <br /> <br /> Each long term agreement would be approved contingent upon <br /> City adoption of general plan amendments to the growth man- <br /> agement element which would permit the total number of units <br /> authorized by the long term agreements. <br /> <br /> 5. Project processing would be permitted to proceed prior to the <br /> actual adoption of general plan amendments. (Possible prob- <br /> lem: Tentative map approvals require a finding of genet~al <br /> plan consistency. The City Attorney has determined that with <br /> appropriate conditions a contingent tentative map approval <br /> could be granted.) <br /> <br /> Long term agreements would permit building permits to be ob- <br /> tained in the year specified for approval and the two calen- <br /> dar years thereafter. (This would be a change from the 1985 <br /> long term agreements which provided that building permits <br /> could be obtained in the year preceding the year specified <br /> for approval but occupancy of the completed unit could not <br /> occur until the year specified for approval.) <br /> <br /> 7. Long term agreements would provide that the right to build <br /> approved units can beperfected by obtaining all building <br /> permits within the specified (3 year) window period. In the <br /> case of s~ngle familylot subdivisions, the right to build <br /> approved units could also be perfected by the filing of a <br /> final map with security sufficient to assure the construction <br /> of all necessary public improvements prior to expiration of <br /> the specified (3 year) window period. <br /> <br />8. Exactions <br /> <br /> a. Long term agreements to include a provision in which <br /> developer agrees to pay the City fees in effect at the <br /> time the building permit is issued (such as a later <br /> adopted school impact fee). <br /> <br /> <br />
