BOX 520 <br /> Pleasanton, CA 94566 <br /> <br /> VALLEY AVENUE EXTENSION AGREEMENT <br /> <br /> (AU[ DER MAUR) <br /> <br /> THIS AGREEMENT is entered into this day of April, 1986 <br /> <br />by and between the CITY OF PLEASANTON, a municipal corporation <br />(hereinafter referred to as "City") and FRANK AUF DER MAUR and <br />KONRAD RICKENBACH. <br /> <br /> RECITALS <br /> <br /> A. Frank Auf der Maur and Konrad Rickenbach own a parcel of <br />land within the City limits of Pleasanton in the vicinity of the <br />proposed Valley Avenue Extension (APN 946-1250-40-3) consisting <br />of approximately 30.05 acres (hereinafter referred to as "Auf der <br />Maur Parcel"). <br /> <br /> B. Santa Anita Development Company ("Santa Anita") has an <br />option to purchase that portion of the Auf der Maur property <br />which is easterly of a proposed extension to Bernal Avenue <br />through the Auf der Maur Parcel as shown on Exhibit "A" <br />ping Center Parcel"). The interest of Auf der Maur and Ricken- <br />bach may be referred to collectively herein as "Landowner". <br /> <br /> C. In August 1985, the California Public Utilities Commis- <br />sion (PUC) approved three at-grade crossings in and adjacent to <br /> <br /> - 1 - <br /> <br /> <br />
