Ordinance No. 1976 <br />Page 4 of 4 <br />(Subsection D, no change.)" <br />Section 9. Section 5 (part) of Ordinance 1550, as amended, and Section 5.20.020 of <br />the Pleasanton Municipal Code are hereby further amended to read as follows: <br />"5.20.020 Businesses not susceptible to measuring the license tax by gross receipts <br />A. In addition to other taxes required under this title, every person conducting or <br />carrying on in the city the operation of anon-revenue producing business shall pay a license tax <br />as specified in the license tax schedule in Section 5.24.040 based on the total of all expenses <br />incurred by the business. at such location during the course of the period covered by the <br />business license in question. This includes, but is not limited to, gross payroll (including <br />benefits), utilities, rent, supplies, consultants and other contracted services, insurance, <br />depreciation and equipment. <br />B. Startup companies shall pay a license tax based on operating expenses until <br />revenues equal or exceed expenses. At that point gross receipts shall become the basis of tax. <br />C. Non-revenue producing businesses shall pay a business license tax based on <br />operating expenses. <br />D. A portion of a business which is a separate and clearly defined non-revenue <br />producing business may be taxed separately under this classification. As to a contractor with an <br />office located in Pleasanton, the contractor will be taxed separately based on office operating <br />expenses." <br />The foregoing Ordinance was introduced at a regular meeting of the City Council of the <br />City of Pleasanton on May 6, 2008 and passed by the following vote. <br />Ayes: Councilmembers McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: Councilmember Cook-Kallio <br />and adopted at a regular meeting of the City Council of the City of Pleasanton on May <br />20, 2008 and passed by the following vote. <br />Ayes: Councilmembers Cook-Kallio, M <br />Noes: None <br />Absent: None <br />ATTEST <br />Karen iaz, City Clerk <br />APPROVED AS TO FORM: <br />~'l~u~.e~e~/,~1,u ~ <br />Michael H.
