Section 3 (part) or Ordinance 1550 and Section 5.08.100 of the <br />Pleasanton Municipal Code are amended to read as follows: <br />"5.08.100 Duplicate license <br />The collector may issue a duplicate license to replace the current year's license <br />previously issued if the licensee files a statement stating that the original license has been lost <br />or destroyed and, at the time of the filing of such statement, the licensee pays a duplicate <br />license fee as provided in the City's current schedule of fees and charges." <br />Section 6. Section 5.08.110 of the Pleasanton Municipal Code is hereby amended to <br />read as follows: <br />"5.08.110 Posting <br />(Subsections A and B, no change.) <br />C. Any licensee transacting and carrying on business but not operating at a fixed <br />place of business in the city shall keep the original license upon the licensee's person at all <br />times while transacting and carrying on the business for which the license has been issued." <br />Section 7. Section 4 of Ordinance 1550, as amended, and Section 5.12.030 of the <br />Pleasanton Municipal Code are hereby further amended to read as follows: <br />"5.12.030 Evidence of doing business <br />When any person (a) by the use of signs, circulars, cards, telephone books, Internet, or <br />newspapers, advertise, hold out or represent that the person is conducting business in the city, <br />(b) holds an active license or permits issued by a governmental agency indicating that the <br />person is conducting business in the city, or (c) makes a sale, takes an order, delivers goods as <br />a private carrier to any destination within the city, renders a commercial service or performs any <br />similar act within the city, such facts shall be considered prima facie evidence that the person is <br />conducting business in the city." <br />Section 8. Section 5.20.010 of the Pleasanton Municipal Code is hereby amended to <br />read as follows: <br />"5.20.010 General <br />(Subsection A, no change.) <br />B. Any person claiming an exemption under this title shall file a sworn statement <br />with the collector stating the facts upon which the exemption is based and provide the collector <br />with proof of the exemption. If the proof of the exemption is based on a federal or state <br />exemption, the person claiming such exemption must provide an original document issued by <br />the federal or state agency concerning the exemption. In the absence of such <br />statement/document substantiating the exemption, the person shall remain liable for the <br />payment of the license taxes imposed by this title. <br />C. The collector shall, upon a proper showing as provided in this section, issue a <br />license to such person claiming an exemption under this section without payment of the license <br />tax. <br />
