These changes also become effective July 1, 2008. As a <br />result, the new Ruby Hill area rates have been included in the attached Resolution to this <br />staff report amending the Master Fee Schedule accordingly. <br />Proposition 218 Notice and Protest Hearing <br />In November 1996 the voters of California adopted Proposition 218. Proposition 218 <br />requires the City to mail information regarding proposed fee increases to every property <br />owner and utility customer; hold a protest hearing at least 45 days after the mailing of the <br />information; and if a majority of the affected property owners protest in writing the increase <br />in the fee(s), the legislative body must reject the proposed fee increase. <br />On or about April 19, 2008, staff delivered approximately 41,000 notices to the post office <br />to mail to all property owners within the City as well as to all City utility customers (some <br />customers may have received two notices due to the particular nuances of the two data <br />bases used) notifying them of the proposed regional sewer rate change (decreases for the <br />most part) effective July 1, 2008. On April 19, 2008, Pleasanton published the Notice of <br />Public Hearing (Notice) in the Valley Times regarding the protest hearing to be held on <br />June 3, 2008 before the City Council. Also, included in the Notice and in the mailed <br />information were the instructions on how to register a protest for tonight's City Council <br />meeting of June 3, 2008. As mentioned, if a majority of the affected property owners' <br />protest in writing, the legislative body must reject the proposed fee increase. Given that the <br />changes result in a decrease in the residential user fee, staff does not anticipate a majority <br />protest of the affected property owners. <br />Page 6 of 7 <br />
