The third finding concerns the health, safety and general welfare <br />of the surrounding area. Staff initially felt that this finding <br />could not be made because the addition of another buildable lot <br />would increase the aesthetic impact on the adjacent historical <br />structure, increase the potential hazard created by the poor sight <br />distance on the driveway, increase the impacts of additional <br />traffic using an access that passes so near to the residence to the <br />west, and generally increase the impact on all of the neighboring <br />property owners. The Board of Adjustment found that, based on the <br />Caltrans studies in regard to stopping factors at various speeds, <br />there is sufficient visibility from the driveway so as not to <br />create a safety hazard. That Board, therefore, made all three <br />required findings. Staff feels, however, that even if the safety <br />of the driveway is no longer an issue, there are enough other <br />concerns, specifically the impacts on the neighboring property <br />owners, to question whether the third finding can indeed be made. <br />Your Council must decide whether enough issues remain concerning <br />the health, safety and general welfare of the surrounding area that <br />the third required finding cannot be made or whether this issue has <br />been satisfactorily mitigated by the applicant, or is <br />insignificant, and that the finding can be made. <br /> <br />Staff Recommendation <br /> <br />Staff feels that enough concerns remain concerning the health, <br />safety and general welfare of the area that all of the required <br />findings cannot be made, and we recommend, therefore, that your <br />Council approve case AP-86-03. If, however, your Council can make <br />the required findings and decide to deny case AP-86-03, thereby <br />granting the variance, staff recommends that the approval be <br />subject to the following condition: <br /> <br />1.
