CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-209 <br /> <br /> RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL AND <br /> APPROVING THE APPLICATION OF JAMES MCDOWELL FOR A <br /> VARIANCE TO ALLOW SUBDIVISION OF A PARCEL WITHOUT THE <br /> REQUIRED FRONTAGE ON APPROXIMATELY 15,500 SQ. FT. <br /> LOCATED AT 435 NEAL STREET (AP-86-03) <br /> <br />WHEREAS, at its meeting of March 10, 1986, the Board of <br /> Adjustment made the required findings and approved the <br /> variance application of James McDowell; and <br /> <br />WHEREAS, this decision was appealed by the City Council so that <br /> it could review the application totally; and <br /> <br />WHEREAS, at its meeting of May 6, 1986, the City Council reviewed <br /> a report (SR 86:131) from the Director of Planning and <br /> Community Development together with copies of staff <br /> reports to the Board of Adjustment regarding this <br /> matter; and <br /> <br />WHEREAS, the City Council held a public hearing at which time <br /> applicant and any other member of the public was offered <br /> an opportunity to present evidence regarding this <br /> appeal; and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That because there are special circumstances having <br /> to do with the efficient utilization of the subject <br /> property, the strict application of the provisions <br /> of the Code would deprive the property owner of <br /> privileges enjoyed by other properties in the <br /> vicinity and under identical zoning <br /> classifications. <br /> <br /> b. That because of the special circumstances mentioned <br /> in paragraph (a) above, the granting of the <br /> variance will not constitute a grant of special <br /> privilege inconsistent with the limitation on other <br /> properties classified in the same zoning district. <br /> <br /> c. That the granting of the variance will not be <br /> detrimental to the public health, safety, or <br /> welfare, or materially injurious to properties or <br /> improvements in the vicinity; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> <br />
