LICENSE AGREEMENT <br /> <br /> This License Agreement is made and entered into this <br /> <br /> day of , effective as of the <br /> <br />day of , by and between Kaiser Sand and <br /> <br />Gravel Company, a Delaware corporation, hereinafter referred to <br /> <br />as "Licensor" and hereinafter <br /> <br />referred to as "Licensee". <br /> RECITALS <br /> <br /> A. Licensor owns that certain real property in the <br /> <br />City of Pleasanton, County of Alameda, California more <br />particularly described in Exhibit "A" attached hereto (the <br />"Property") on which there presently exists a road which begins <br />at the easterly terminus of Busch Road where it enters the <br />Property and extends to the contiguous parcel currently owned <br />by Rhodes-Jamieson, more particularly described in Exhibit "B" <br />attached hereto (the "Rhodes-Jamieson Parcel"). Said road is <br />herein called the "El Charro Route". <br /> <br /> B. Licensee is the owner of that property located <br /> <br />north of the Western Pacific Railroad main line which is <br /> <br />described in Exhibit "C" attached hereto ("Licensee's Parcel"). <br /> <br /> C. Pursuant to that Valley Avenue Extension <br /> <br />Agreement by and between the City of Pleasanton and Licensor, <br /> <br />dated , 1986, Licensor agreed to grant Licensee a <br /> <br />non-exclusive license to use the E1 Charro Route pursuant to <br /> <br /> the terms and conditions of this Agreement. <br /> <br /> EXH)BIT B <br /> <br /> <br />
