The Valley Avenue Extension consists of the extension of <br /> Valley Avenue from Quarry Lane to Stanley Boulevard and upgrading <br /> the Busch Road connection to Valley Avenue to be a public gated <br /> crossing. <br /> <br /> E. The Property is within the area which will receive <br />special benefit from the proposed Valley Avenue ExtenSion <br />Project, and the effects of land uses on the Property will be <br />mitigated by completion of the Valley Avenue Extension Project. <br /> <br /> NOW, THEREFORE, in consideration of the faithful performance <br />of the terms, conditions, covenants and promises set forth <br />herein, the parties hereto agree as follows: <br /> <br /> 1. Mitigation Required. City agrees that the effects of <br />Z-86-67 will be mitigated by completion of the Valley Avenue <br />Extension Project. <br /> <br /> 2. Assessment District. City reserves the right to include <br />the Property in an Assessment District or Benefit District which <br />may be established by City to finance the Valley Avenue <br />Extension, as finally approved. <br /> <br /> 3. Support for Assessment District. Landowners agree to <br />either (i) not protest establishment of the District, or (ii) <br />affirmatively vote for creation of the District or other <br />mechanism, depending on the manner of creation of the funding <br />mechanism. <br /> <br /> - 2 - <br /> <br /> <br />
