PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-46 <br />RESOLUTION APPROVING CASE UP-87-6, APPLICATION OF LARRY <br />EVANS AND THE GAME STATION FOR A CONDITIONAL USE PERMIT <br />WHEREAS, Larry Evans has applied for a conditional use permit to <br />operate a game arcade located at 4301 Valley Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial District; and <br />WHEREAS, at their duly noticed public hearing of April 22, 1987 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission finds that the proposed location <br />of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purposes of <br />the district in which the site is located. <br />Valley Plaza comprises a combination of commercial and <br />office developments. The subject site is zoned <br />"PUD-Commercial." Game arcades are a conditionally <br />allowed use in most subdistricts of the "C" (Commercial) <br />Zoning district. One of the purposes of the "C" <br />district is to provide opportunities for amusement <br />establishments for the convenience of the public; and <br />WHEREAS, the Planning Commission finds that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the <br />vicinity. <br />Problems have arisen over the past five years of the <br />previous use permit for the subject site. However, as <br />conditioned below, the use permit will enable stronger <br />enforcement of existing provisions and additional review <br />of the situation in the short term; and <br />WHEREAS, the Planning Commission finds that the proposed <br />conditional use will comply with each of the applicable <br />provisions of this chapter. <br />The proposed use will comply with all applicable <br />sections of Chapter 18.124 of the Pleasanton Municipal <br />Code regarding Conditional Uses; and <br />- 1 - <br />
