12. That final design of the noise barrier to be located along <br />the west property line of the project site shall be submitted <br />to the Planning Director for review and approval prior to the <br />securing of a building permit. <br />13. That the recommendations for measures to ensure the <br />preservation and maintenance of trees affecting the project <br />as contained in the tree survey performed by Hort Science, <br />Inc., dated April 28, 1987 shall be incorporated in the <br />project design and construction, unless otherwise revised by <br />the City Engineer. <br />14. That the final design of fencing for the private open spaces <br />and for the north and east property line of the property <br />shall be submitted to the Planning Director for review and <br />approval prior to construction. <br />15. That the on-site water, sanitary sewer, and storm drainage <br />systems for this development shall be private and be <br />maintained by the property owners association. <br />16. That the developer/owner shall dedicate to the City for <br />street right-of-way purposes the parcel of land necessary to <br />complete the cul-de-sac right-of-way area. <br />17. That the developer shall replace the existing curb and gutter <br />and the existing sidewalk along the St. John Street frontage <br />of this development unless otherwise approved by the City <br />Engineer. The back edge of the new 5' wide sidewalk shall be <br />at property line. <br />18. That the developer shall reconstruct St. John Street from the <br />west curb return on St. John Street to the end of the street <br />near the Union Pacific Railroad. St. John Street shall <br />terminate in a standard City cul-de-sac (45' radius to <br />property line). Final location of the cul-de-sac is subject <br />to Union Pacific Railroad approval, and grant of <br />right-of-way. Any in-lieu payments for street improvements <br />received from projects on the south side of this section of <br />St. John Street shall be paid to the developer subject to <br />terms of any reimbursement agreement. <br />19. That the developer shall design and construct a joint storm <br />drain system from the St. John Street cul-de-sac to the <br />Arroyo de Valle through west drive of the project; City will <br />reimburse developer for any storm drain work that is beyond <br />the developers normal responsibility; extent of the <br />developer's obligation shall be determined prior to the <br />recordation of the final map. <br />20. That if growth management approval for this project has not <br />been secured within two years from date of development plan <br />approval, the development plan approval shall lapse. <br />
