PROJECT DESCRIPTION <br />Based on the Planning Commission's recommendation to the City Council and the <br />agreement that was signed by both the Spencers and Mr. Besso, the Spencers are <br />agreeable to modifying Condition of Approval No. 8, for Lot 8 only, of PUD-99-01, as <br />shown below: <br />"8. The proposed modification would reduce the rear <br />and side yard setbacks for a pool with a spa and waterfall feature to be located in the <br />northern rear yard of the lot. The total depth of the rear yard from building wall to fence <br />is approximately 53 feet in length. The width of the proposed pool is approximately <br />17 feet at its widest. The closest portion of the pool would be located approximately <br />19 feet, 11 inches from the rear of the applicant's house and approximately 10 feet from <br />the rear fence. Staff has modified the scaled drawing on the following page to illustrate <br />what was initially proposed by the Spencers and what was agreed to by the two parties. <br />Page 4 of 7 <br />
