16. Continued Public Hearing: PUD-71, Michael Aminian/Vineyard Gardens, LLC - <br />Consider an application for Planned Unit Development (PUD) rezoning and development <br />plan approval to rezone an approximately .876-acre parcel from RM-4,000 <br />(Multiple-Family Residential) to PUD-HDR (Planned Unit Development -High Density <br />Residential) and to construct ten townhouse units at the property located at 3835 Vineyard <br />Avenue; and approved the draft affordable housing agreement <br />Special Projects Manager Jerry Iserson gave the staff report and a brief description of the <br />project, its zoning and density requirements and rezoning request and said units range from <br />2300 to 2400+ square feet as well as a below market-rate unit of 1000 square feet with <br />affordable housing. He described surrounding development in the area, presented the proposed <br />site plan, ingress and egress, resident and guest parking, rear yards, a common open space <br />area, building elevations, revised plans and minimal traffic impacts. A neighbor voiced initial <br />concerns with view impacts, but he reported that the building is below 30 feet and lower than the <br />actual grade of the sidewalk, and staff finds that the applicant has reduced any visual impact. <br />The Planning Commission voted 3-0 to approve it, the Housing Commission recommended <br />approval of an affordable housing agreement, and staff believes this is an excellent example of <br />an infill project close to the downtown and recommended its approval subject to conditions in <br />the staff report. <br />Mayor Hosterman confirmed the project is a 10-unit condominium project before the Council for <br />rezoning and development plan approval. <br />Councilmember McGovern confirmed the project was approximately '/2 mile from the park on <br />Vineyard Avenue and that the project was close enough to utilize the park. She suggested the <br />applicant consider adding the tot lot into the existing park which would provide equipment for <br />younger children than what currently exists. <br />Mayor Hosterman opened the public hearing. <br />Ronald Marovich, President of the Shadow Creek HOA, said and lives directly west of the <br />project, has attended all meetings, voiced initial concern about his front door view to the back of <br />the project, but was very happy with the applicant's revisions to the building and upgrade of the <br />fence between the two properties and asked for the Council's support. <br />Mayor Hosterman closed the public hearing. <br />Michael Aminian, Vineyard Gardens, LLC, thanked City staff and residents for their support and <br />assistance with the project. <br />Councilmembers thanked Mr. Aminian for working with the neighbors and with staff, including a <br />below market rate unit and were supportive of the revisions. Councilmember McGovern asked <br />Mr. Aminian to consider installing the tot lot at the existing park for the benefit of younger <br />children. <br />Motion: It was m/s by McGovern/Sullivan to Introduce Ordinance No. 1975 approving an <br />application for Planned Unit Development (PUD) rezoning and development plan approval to <br />rezone an approximately .876-acre parcel from RM-4,000 (Multiple-Family Residential) to <br />PUD-HDR (Planned Unit Development -High Density Residential) and to construct ten <br />townhouse units at the property located at 3835 Vineyard Avenue; and approved the draft <br />affordable housing agreement.
