17.04.120 <br />the condominium conversion project, may <br />be brought before the board of adjustment <br />for a hearing and resolution. The decision <br />of the board of adjustment shall be appeal- <br />able to the city council. (Prior code § 2- <br />25.12) <br />17.04.130 Public policy-Lease <br />provisions and evictions. <br />A. It shall be against the public policy <br />embodied in this chapter to attempt to sub- <br />vert its provisions by coercing the waiver <br />of any rights or privileges created or pro- <br />tected herein. Any provision of a lease or <br />rental agreement which purports to waive a <br />tenant's rights under this chapter or which <br />requires prior consent to the conversion of <br />the apartment building, apartment com- <br />plex, or mobile home park to a condomin- <br />ium conversion project shall be null, void <br />and unenforceable. <br />B. It shall be against the public policy <br />embodied in this chapter to evict or <br />threaten to evict or otherwise harass any <br />tenant because of the tenant's refusal to <br />consent to conversion, the tenant's opposi- <br />tion to such conversion or the anticipated <br />refusal or opposition of the tenant.
