Note: due to personnel belonsings, equipment and other debris, additional inspections are <br />required to be performed for a complete safety inspection of the tenant space. <br />7.28.200 Violation-Penalty. <br />A. Any person, firm or corporation violating or causing, or permitting to be violated any of the <br />provisions of this chapter shall be deemed guilty of an infraction unless such violation is described as a <br />misdemeanor by specific provisions of this chapter. <br />B. Any person, firm or corporation convicted of a misdemeanor under the provisions of this chapter <br />shall be subject to a fine or imprisonment, or both, not to exceed the limits set forth in California Penal <br />code Section 19. <br />C. Any person, firm or corporation convicted of an infraction under the provisions of this chapter shall <br />be punishable upon a fast conviction by a fine of not more than one hundred dollars ($100), and for a <br />second conviction within a period of one (1) year by a fine of not more than two hundred dollars ($200), <br />and for a third or any subsequent conviction within a one (1) year period by a fine of not more than five <br />hundred dollars ($500). Any violation beyond the third conviction within a one (1) year period may be <br />charged by the District Attorney as a misdemeanor and the penalty for conviction of the same shall be <br />subject to a fine or imprisonment, or both, not to exceed the limits set forth in California Penal Code <br />Section 19. <br />D. In addition to the penalties provided in this section, any condition caused or permitted to exist in <br />violation of any of the provisions of this chapter shall be deemed a public nuisance and may be by the <br />City summarily abated as such. <br />E. Each person, firm or corporation shall be guilty of a separate offense for each and every day during <br />any portion of which any violation of any provision of this chapter is committed, continued or permitted <br />by such person and shall be punishable accordingly. <br />F. The Building Official shall have the power to designate by written order that particular officers or <br />employees shall be authorized to enforce particular provisions of this chapter. Officers or employees so <br />designated shall have the authority to arrest persons who violate any said provisions. <br />Zoning Violations: <br />The followine Conditions of Approval for PA02-058 were found to be out of compliance and are <br />enforced. by the Planning Division: <br />Condition of Approval # 5: "Hours of Operation. Hours of Operation for the martial arts school and <br />youth center shall be from 7:15 a. m. to 9 p. m. Monday through Friday. No youth programs shall occur <br />on the weekend. " <br />Condition of Approval #7: "Maintenance. The Applicant shall be responsible for cleaning up and <br />disposing of school generated trash and litter on-site and off-site within the center. " <br />Condition of Approval #11: "Tenant space shall be used in the manner represented in application <br />plans, written statements and other documents submitted as part of the application.
