THE CITY OF <br />-- °~ -~- "" CITY COUNCIL AGENDA REPORT <br />~'L~£~S~4NTON® <br />April 15, 2008 <br />Public Works Department <br />TITLE: ADOPT A RESOLUTION ABANDONING A PORTION OF A PUBLIC <br />SERVICE EASEMENT WITHIN TRACT 5902 (742 FOXBROUGH PLACE) <br />SUMMARY <br />As a result of a new gravity sanitary sewer main between the Foxbrough sanitary sewer <br />pump station and the realignment of Vineyard Avenue, a portion of a public service <br />easement where the pump station is located is no longer needed and can be <br />abandoned. This easement is approximately 238 square feet, and is located on Lot 5 of <br />Tract 5902, Foxbrough II. Abandoning the easement removes the encumbrance on the <br />property and allows the property owners to more fully utilize their property. <br />RECOMMENDATION <br />Adopt the attached resolution abandoning an approximately 238 square foot portion of a <br />public service easement and authorize the City Clerk to record the resolution <br />abandoning the City's interest therein. <br />FINANCIAL STATEMENT <br />There will be no fiscal impact to the City by abandoning this portion of the easement. <br />
