D. The ownership of the Electric and Street Lighting Facilities <br />shall vest in PGandE, as authorized by the provisions of Sections 10109, 10110 <br /> <br />and 10111 of the Streets and Highways Code of the State of CalifQ~nia. <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> 1. City shall pay to PGandE upon demand, and prior to any <br />construction by PGandE, the nonrefundable amount of $73,713 which represents <br />PGandE's cost to relocate the Electric Facilities as shown on Exhibit "A". <br /> <br /> 2. PGandE shall furnish and install the Street Lighting Facilities <br />(except for the bases and the poles which are to be installed by City) within <br />the District as shown on Exhibit "A" in accordance with the provisions of <br />PGandE's Schedule LS-1, a copy of which is attached and made a part hereof. <br /> <br /> 3. City shall pay PGandE prior to the furnishing of any work or <br />materials relating to the Street Lighting Facilities, the nonrefundable amount <br />of $30 which represents the cost of internal wiring for two poles ($26) and the <br />material cost for 15 feet of excess conductor ($4). <br /> <br /> 4. In accordance with the Class C rates of Schedule LS-1, or such <br />other schedules as may hereafter be applicable for service to such a street <br />lighting system, City shall be responsible for the monthly service charge for <br />all Street Lighting Facilities installed hereunder. <br /> <br /> 5. This agreement does not provide for the installation by PGandE <br /> <br />of any underground conduits and/or conductors extending from the Electric Facil- <br />ities to any existing or proposed building within the District other than as <br />provided in the attached plans and specifications. The obligations of both the <br />property owners and PGandE under PGandE's Electric Rule No. 16 on file with the <br />California Public Utilities Commission (Commission), relating to service <br />installations, are not included in this agreement. <br /> <br /> 2: <br /> <br /> <br />
