PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-119 <br />RESOLUTION RECOMMENDING APPROVAL OF CASE PUD-81-30-41D, <br />LYON'S RESTAURANT <br />WHEREAS, Lyon's Restaurant has applied for design review approval <br />to construct an approximately 4,744 sq. ft. restaurant <br />and related improvements on an approximately 0.27 acre <br />site within Gateway square, an approved commercial <br />center located at 4889 Hopyard Road; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial, Industrial, and Offices <br />District; and <br />WHEREAS, at their duly noticed public hearing of November 11, <br />1987, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, an Environmental IMpact Report (EIR) was prepared for <br />the rezoning of the subject property. Architectural and <br />site design for the subject property was included within <br />the scope of that EIR and, therefore, this application <br />is not considered to be a new project under the <br />California Environmental Quality Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of Case PUD-81-30-41D as herein <br />described subject to the following-conditions: <br />That the development shall conform substantially to <br />the plans and elevations, Exhibit A (dated October <br />15, 1987), on file with the Planning Department, <br />except: <br />a. The freestanding monument sign proposed for <br />the Hopyard Road frontage shall be deleted <br />from the site plan. <br />2. That the development shall be subject to all <br />applicable conditions of approval for Case <br />PUD-81-30-35D. <br />That the applicant shall make an application and <br />receive approval for a conditional use permit prior <br />to opening the restaurant to the public if they <br />desire to serve alcoholic beverages after the hours <br />of 10:00pm. <br />- 1 - <br />
