PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-87-119 RESOLUTION RECOMMENDING APPROVAL OF CASE PUD-81-30-41D, LYON'S RESTAURANT WHEREAS, Lyon's Restaurant has applied for design review approval to construct an approximately 4,744 sq. ft. restaurant and related improvements on an approximately 0.27 acre site within Gateway square, an approved commercial center located at 4889 Hopyard Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - Commercial, Industrial, and Offices District; and WHEREAS, at their duly noticed public hearing of November 11, 1987, the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, an Environmental IMpact Report (EIR) was prepared for the rezoning of the subject property. Architectural and site design for the subject property was included within the scope of that EIR and, therefore, this application is not considered to be a new project under the California Environmental Quality Act (CEQA). NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Recommends approval of Case PUD-81-30-41D as herein described subject to the following-conditions: That the development shall conform substantially to the plans and elevations, Exhibit A (dated October 15, 1987), on file with the Planning Department, except: a. The freestanding monument sign proposed for the Hopyard Road frontage shall be deleted from the site plan. 2. That the development shall be subject to all applicable conditions of approval for Case PUD-81-30-35D. That the applicant shall make an application and receive approval for a conditional use permit prior to opening the restaurant to the public if they desire to serve alcoholic beverages after the hours of 10:00pm. - 1 -
