Resolution No. PC-87-129 <br />December 9, 1987 <br />intersection of Foothill Road and Old Dublin Canyon Road <br />subject to the following conditions: <br />1. That the development be substantially as shown on <br />Tentative Tract Map 5811 on file with the Planning <br />Department. <br />2. That approval of Tentative Tract Map 5811 is <br />subject to all conditions contained in the report <br />from the City Engineer, dated November 11, 1987, <br />attached hereto and made a part of this case by <br />reference. <br />3. That the development is subject to all conditions <br />of approval for Case PUD-87-04. <br />4. The grading and drainage plans required as part of <br />the improvement plans for this development shall <br />include both the site development and all <br />applicable future configurations of Dublin Creek. <br />5. The developer shall create a homeowners <br />association. The homeowners association shall be <br />responsible for maintaining all common open space <br />and private utilities, which include streets and <br />storm drainage. The City shall be granted the <br />right and remedies of the association, but not the <br />obligation, to enforce the maintenance obligation. <br />The City Attorney shall review and approve the <br />proposed covenants, conditions, and restrictions <br />prior to recording the final map. A copy of the <br />CC&R's shall be submitted for review by the City <br />Engineer as part of the tract improvement plans. <br />6. That the developer offer to dedicate the entire <br />Dublin Creek right-of-way to Zone 7 and reserve a <br />33 foot setback within the right-of-way for <br />possible future use by the City in widening Dublin <br />Canyon Road to its ultimate 4-lane width. <br />7. That all improvements within and adjacent to both <br />branches of Dublin Creek be reviewed and approved <br />by Zone 7 and the California Department of Fish and <br />Game prior to approval of the final map. <br />8. That the applicant obtain an encroachment permit <br />from Caltrans prior to approval of the final map. <br />9. That the tentative map not take effect until the <br />related application for a minor modification is <br />approved by the Planning Director and the appeal <br />period is lapsed. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br />-~ 2 - <br />
