PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-130 <br />RESOLUTION APPROVING CASE UP-87-52 FOR SYLVAN LEARNING <br />CENTER/PORTFOLIO PROPERTIES <br />WHEREAS, Sylvan Learning center and Portfolio Property Investors <br />have applied for a conditional use permit to establish a <br />learning/tutoring center to be located at 3015 Hopyard <br />Road; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) Central Commercial District; and <br />WHEREAS, at their duly noticed public hearing of December 9, <br />1987, the Planning Commission considered all public <br />testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the Planning Commission made the following findings <br />concerning this application: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purposes of the district in which <br />the site is located. <br />The proposed use requires relatively simple <br />physical facilities in which to operate. The <br />shopping center can provide an appropriate <br />environment in which such an instruction-oriented <br />use would be compatible with adjacent retail/office <br />uses and consistent with the objectives of the <br />commercial PUD District in which it is located. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties of improvements in the vicinity. <br />The proposed use should not adversely affect the <br />availability of parking spaces in the shopping <br />complex and provisions for interior storage of <br />bicycles should reduce potential hazards to <br />vehicular and pedestrian circulation which might <br />otherwise occur. The proposed use is to be <br />operated entirely indoors and activities should not <br />interfere with adjacent uses. Interior space <br />improvements will be in accordance with the City's <br />Building Code. As conditioned, the proposed use <br />will not be detrimental to the public health, <br />- 1 - <br />
