CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-197 <br /> <br /> RESOLUTION APPROVING THE APPEAL OF RIDGEWOOD <br /> CONSTRUCTION COMPANY OF A PLANNING COMMISSION DECISION <br /> DENYING THE APPLICATION FOR A CONDITIONAL USE PERMIT TO <br /> ESTABLISH A MODEL HOMES COMPLEX AT THE INTERSECTION OF <br /> EL CAPITAN DRIVE AND WHITNEY DRIVE (AP-87-8) <br /> <br />WHEREAS, at its meeting of April 7, 1987, the Planning Commission <br /> denied the application of Ridgewood Construction for a <br /> conditional use permit to establish a model homes <br /> complex at the intersection of E1 Capitan Drive and <br /> Whitney Drive; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the applicant submitted an appeal to the City <br /> Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, at its meeting of May 5, 1987, the City Council reviewed <br /> a report (SR87:212) from the Director of Planning and <br /> Community Development together with copies of staff <br /> reports to the Planning Commission regarding this <br /> matter; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time <br /> applicant and any other member of the public was offered <br /> an opportunity to present evidence regarding this <br /> appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the appeal of Ridgewood Construction Company <br /> to a decision of the Planning Commission denying the <br /> conditional use permit to establish a model homes <br /> complex to be located at the intersection of E1 Capitan <br /> Drive and Whitney Drive and therefore approves such <br /> model home complex subject to to the following <br /> conditions: <br /> <br /> 1. That the proposed model home/sales complex be <br /> substantially as shown on the plans on file with <br /> the Planning Department except that the proposed <br /> fencing across sidewalks and whitney and E1 Capitan <br /> Dives shall be eliminated. <br /> <br /> 2. That this use permit shall be granted and effective <br /> for a period of two years or until the use of the <br /> complex is terminated, whichever occurs first. <br /> <br /> <br />
