CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-197 RESOLUTION APPROVING THE APPEAL OF RIDGEWOOD CONSTRUCTION COMPANY OF A PLANNING COMMISSION DECISION DENYING THE APPLICATION FOR A CONDITIONAL USE PERMIT TO ESTABLISH A MODEL HOMES COMPLEX AT THE INTERSECTION OF EL CAPITAN DRIVE AND WHITNEY DRIVE (AP-87-8) WHEREAS, at its meeting of April 7, 1987, the Planning Commission denied the application of Ridgewood Construction for a conditional use permit to establish a model homes complex at the intersection of E1 Capitan Drive and Whitney Drive; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, at its meeting of May 5, 1987, the City Council reviewed a report (SR87:212) from the Director of Planning and Community Development together with copies of staff reports to the Planning Commission regarding this matter; and WHEREAS, a duly noticed public hearing was held at which time applicant and any other member of the public was offered an opportunity to present evidence regarding this appeal; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the appeal of Ridgewood Construction Company to a decision of the Planning Commission denying the conditional use permit to establish a model homes complex to be located at the intersection of E1 Capitan Drive and Whitney Drive and therefore approves such model home complex subject to to the following conditions: 1. That the proposed model home/sales complex be substantially as shown on the plans on file with the Planning Department except that the proposed fencing across sidewalks and whitney and E1 Capitan Dives shall be eliminated. 2. That this use permit shall be granted and effective for a period of two years or until the use of the complex is terminated, whichever occurs first.
