PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION N0. PC-87-43
RESOLUTION APPROVING CASE UP-87-7, KMA MARTIAL ARTS
ACADEMY
WHEREAS, Kang Yil Park and KMA Martial Arts Academy has applied
for a conditional use permit to allow for the operation
of a studio for the instruction of martial arts to be
located at 3003-B Hopyard Road; and
WHEREAS, zoning for the property is PUD (Planned Unit
Development) - Central Commercial District; and
WHEREAS, the Planning Commission found that the proposed location
of the conditional use is in accordance with the
objectives of the zoning ordinance and the purposes of
the district in which the site is located.
The proposed use requires relatively simple physical
facilities in which to operate. The shopping center can
provide an appropriate environment in which such an
instruction-oriented use would be compatible with
adjacent retail/office uses and consistent with the
objectives of the commercial PUD District in which it is
located; and
WHEREAS, the Planning Commission found that the proposed location
of the conditional use and the conditions under which it
would be operated or maintained will not be detrimental
to the public health, safety, or welfare, or materially
injurious to the properties of improvements in the
vicinity.
The proposed use should not adversely affect the
availability of parking spaces in the shopping complex
and provisions for storage of bicycles should reduce
potential hazards to vehicular and pedestrian
circulation which might otherwise occur. The proposed
use is to be operated entirely indoors and activities
should not interfere with adjacent uses. Therefore, the
proposed use will not be detrimental to the public
health, safety, and welfare nor will it pose a threat to
surrounding properties or improvements; and
WHEREAS, the Planning Commission found that the proposed
conditional use will comply with each of the applicable
provisions of this chapter.
As conditioned, the proposed use will comply with all
provisions and requirements of the zoning ordinance; and
- 1 -
