PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />NO. PC-88-31 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR GERI <br />GIUSTI, AS FILED UNDER CASE UP-88-4 <br />WHEREAS, Geri Giusti has applied for a conditional use permit to <br />operate a restaurant and catering activities to be <br />located at 7063-H Commerce Circle; and <br />WHEREAS, zoning for the property is IG (General Industrial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of March 9, 1988, <br />the Planning Commission considered all public testimony, <br />relevant exhibits, and recommendations of the City staff <br />concerning this proposal; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purposes of the district in which <br />the site is located. <br />Commerce Circle is a general industrial area. A <br />restaurant is a support use which is recognized as <br />appropriate for the I-G district within the listed <br />conditional uses in section 18.48.190 of the <br />Municipal Code. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />As conditioned, and as subject to mandatory health <br />and fire inspections, the restaurant will not be <br />detrimental to the public health, safety, or <br />welfare, or materially injurious to the properties <br />or improvements in the vicinity. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the Zoning <br />Ordinance. <br />As conditioned, the proposed restaurant meets all <br />of the provisions of the Zoning Ordinance; and <br />- 1 - <br />
