PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-44 <br />RESOLUTION RECOMMENDING APPROVAL OF CASE <br />PUD-81-22-1M-1D, APPLICATION OF MOZART DEVELOPMENT <br />WHEREAS, Mozart Development Company has applied for design review <br />approval to construct an approximately 8,400 sq. ft. <br />restaurant and related improvements to be located on an <br />approximately 1.2 acre site located at the eastern <br />terminus of Embarcadero Court; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial and Offices District; and <br />WHEREAS, at their duly noticed public hearing of May il, 1988, <br />the Planning Commission considered all public testimony, <br />relevant exhibits, and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found the proposed modifications <br />as shown in the revised plans distributed 5/11/88 to be <br />appropriate for the subject site. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of PUD-81-22-1M-1D, application <br />of Mozart Development Company for design review approval <br />to construct an approximately 8,400 sq. ft. restaurant <br />and related improvements to be located on an <br />approximately 1.2 acre site located at the eastern <br />terminus of Embarcadero Court subject to the following <br />conditions: <br />1. That the development be substantially as shown on <br />the plans (receipt dated of May 24, 1988), Exhibit <br />A, on file with the Planning Department. <br />2. That the screen wall and trash enclosure be <br />designed to be architecturally compatible with the <br />building design, the final design of which shall be <br />submitted for final review and approval of the <br />Planning Director prior to issuance of any building <br />permits. <br />3. That because unacceptable traffic levels of service <br />will exist at the Foothill/Canyon Way intersection <br />until the Stoneridge Drive/2-680 interchange is <br />operational, no City building or grading permits <br />shall be issued for the project until construction <br />has commenced on the interchange. <br />- 1 - <br />
