CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-177 <br /> <br /> RESOLUTION APPROVING EXCHANGE OF PROPERTY IN THE MISSION <br /> MILLS AREA AND VACATING A PORTION OF DOLORES COURT AT <br /> DOLORES DRIVE <br /> <br />WHEREAS, on May 5, 1987, the City Council received a staff report <br /> (SR7:184) regarding necessary actions for completion of <br /> the conditions of the Exchange Agreement with Castlewood <br /> Properties regarding the Mission Hill area; and <br /> <br />WHEREAS, due to the reconfiguration of Dolores Court at Dolores <br /> Drive, it is necessary to vacate a portion of Dolores <br /> Court as more particularly described in Exhibit "A" <br /> attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, the excess street right-of-way is no longer required for <br /> street purposes; and <br /> <br />WHEREAS, public convenience and necessity require the reservation <br /> of an easement for public service over said vacated <br /> land; and <br /> <br />WHEREAS, due to the reconfiguration of Dolores Court and Dolores <br /> Drive, the configuration of the public service easement <br /> is also changed and it is necessary and appropriate to <br /> vacate a portion of the former public service easement; <br /> and <br /> <br />WHEREAS, the owners of Lot 37, Tract 4611, Mr. and Mrs. Robert <br /> Flaherty, have agreed to execute a Grant Deed to the <br /> City for the property necessary to reconfigure Dolores <br /> Drive, Dolores Court and the proposed Dolores Place and <br /> acceptance of this deed is in the public interest; and <br /> <br />WHEREAS, in conjunction with the land exchange, a 20-foot public <br /> service easement should be granted to owners of the <br /> former Mission Hill Park site for public utilities <br /> across City park land; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes execution of a Grant of Easement over City <br /> property to the proposed owners, Blackburn/Graham No. 1 <br /> Associates, of the Mission Hill Park site as described <br /> in the attached Exhibit "A". <br /> <br /> Section 2: Council finds that the land exchanged pursuant to the <br /> Exchange Agreement with Castlewood Properties is of <br /> equal or greater value and authorizes the Mayor to <br /> execute all documents to vacate such public service <br /> easement and right-of-way and to reconfigure Dolores <br /> <br /> <br />
