City of Pleasanton <br /> <br /> .STAFF <br /> REPORT <br /> <br />April 1, 1987 <br /> <br />HONORABLE MAYOR AND COUNCILMEMBERS <br /> Pleasanton, California <br /> <br />Subject: Authorize City Manager to Enter Into Release Re Hyde <br /> Park Public Easement Improvements. <br /> <br />Honorable Mayor and Members of the Council: <br /> <br />Background <br /> <br />This item results from the efforts of five neighbors to obtain <br />satisfaction for promises apparently made by the original <br />developer of the Hyde Park project at a Planning Commission <br />meeting in 1981. At that time, the proponent of the Hyde Park <br />project promised the neighbors that their back fences would be <br />replaced and that a row of eucalyptus trees adjacent to those <br />fences would be replaced with a more compatible tree if the <br />neighbors withdrew their opposition to the project. This promise <br />did not get incorporated in the conditions of project approval. <br /> <br />fin late 1985 and again in October 1986, the neighbors (led by Bob <br />Persky) appeared before Council to request the City's assistance <br />in getting the fences replaced and the eucalyptus trees removed. <br /> <br />The subject area is a 25 to 40 ft. strip of land on the northerly <br />side of the Hyde P~rk project. This strip of land was designated <br />as a public easement area on the PUD fo~ Hyde Park so that school <br />children from the adjacent neighborhood could proceed from <br />Fairlands Drive to Fairlands School without having to walk all <br />the way to West Las Positas. <br /> <br />The neighbors' problem with the developer coincided with other <br />problems which the City staff were having with the developer of <br />the Hyde Park project. In fact, the City staff had refused to <br />accept public improvements within the pedestrian easement area <br />because of the incorrect location and elevation of the sidewalk <br />which was causing a drainage problem to the neighbors and even to <br />units within the Hyde Park project itself.
