The wall in question is located
behind :Flap's Restaurant and was constructed without the proper City approval process and without any prior
discussion with the surrounding property owners.
The exi~:tence of the wall has created numerous health and safety issues as well as obstacles to the functionality
ofthe surrounding neighborhood. Specifically, the wall seriously compromises the ability of restaurant patrons
to exit I~[ap's Restaurant in the event of an emergency and also restricts emergency workers free access to our
property. The wall has also functionally eliminated the only handicapped parking space servicing our property
and has~~severely limited our ability to remove garbage from the restaurant using the best sanitary practices.
The wall was constructed on a Saturday last June and we have patiently attempted to resolve these issues with
the adjoining property owner for over a year. Unfortunately, our efforts to find a workable solution have failed
and we --rust seek official action to have this wall removed immediately. We appreciate your earlier assistance in
attempting to help find a compromise to this situation, but our tenants who operate Hap's Restaurant have
officiall~v notified us that the current condition of the property is a safety issue, is an alteration of the property
and thermfore their lease that they never agreed to, and is unacceptable for the continuation of their business
using best practices. As a result, we are formally requesting the City of Pleasanton take enforcement action to
remove ~U:he wall and return the condition of the property to the condition prior to any non-approved construction
work.
Thank y;~u in advance for all your efforts in assisting us with this matter.
Sincerel~;i,
Q~~~~~~^
~.
