The dispute <br />is not healthy for the vitality of your property, Madden's property, and the surrounding downtown area. I hope you <br />feel the same way. <br />I understand that the construction of the wall was motivated by issues which have been occurring between Haps <br />and your property. Nevertheless, I don't believe that construction of the wall was the best way to resolve these <br />issues, and, in my opinion, the City did not follow the correct procedures in approving this wall since the plans <br />were incomplete and impacts to adjacent properties were not fully considered. <br />From the City's perspective, the main issue is a public health and safety concern involving the need for garbage to <br />continue to be collected in a reasonable manner. As it stands now, the presence of the new block wall adjacent to <br />your new trash enclosure area and along a portion of your westerly property line prevents the collection of <br />garbage from the Madden property in the manner in which it has occurred for many years, which involves the use <br />of your parking lot for the garbage truck to access dumpsters. In the interests of resolving this issue, I believe that <br />an opening in -the wall should be created immediately so that we can restore garbage service as it had been <br />occurring prior to construction of the wall. I am willing to explore other options as well...but need your help in <br />coming to the table with me and Mike Madden to successfully resolve this issue. <br />I know you have other concerns regarding about how your property has been used in the past. I know that Mike <br />Madden is willing to resolve your concerns as well. <br />Please respond to me at your earliest convenience so that we can discuss this at our meeting with Mike Madden <br />tomorrow.
