EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD-81-28-5M, City of Pleasanton <br />As Approved by the Planning Commission on February 13, 2008 <br />1. The masonry wall shall be maintained in substantial conformance to the <br />development plans, Exhibit A, dated "Received, July 10, 2007", on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved Exhibit A. <br />2. The gate as constructed is not approved and shall be re-designed and <br />reconstructed to meet Building Code and Fire Code emergency access <br />requirements. The gate shall be designed with panic hardware to allow <br />unrestricted egress from 122 W. Neal Street at all times but may be secured to <br />prevent ingress onto 122 W. Neal Street so long as the gate is modified to <br />provide a Knox Box or similar mechanism to allow Fire Department emergency <br />access to 122 W. Neal Street and to allow Pleasanton Garbage Service <br />personnel to have access to 122 W. Neal Street for the purpose of moving the <br />dumpster on that property to and from the Pleasanton Station/Railroad Square <br />property for purposes of emptying the dumpster. The design of the gate shall be <br />submitted for the review and approval of the Chief Building Official, the Fire <br />Marshal, and the Planning Director within 30 days of approval of PUD-81-28-5M, <br />and the gate shall be modified according to the approved plans within 30 days of <br />approval by the City. The City shall pay the cost of the gate modifications. <br />3. The owner of the Pleasanton Station/Railroad Square property shall record an <br />easement in favor of the owner of the Hap's Restaurant property granting <br />emergency access from 122 W. Neal Street through the gate in the masonry wall <br />referenced in Condition # 2 leading to the concrete pad in front of the trash <br />enclosure for Pleasanton Station/Railroad Square. The easement shall be <br />subject to the review and approval of the City Attorney and shall be submitted to <br />the City Attorney within 30 days of approval of PUD-81-28-5M. The easement <br />shall not be recorded until the property at 122 W. Neal Street (a) has been <br />striped or otherwise appropriately marked (as determined by the Fire Marshal) to <br />delineate that portion of the property that must be kept free of any obstructions at <br />all times for purposes of emergency access from the building on 122 W. Neal <br />Street to the gate referenced in Condition # 2 and (b) has had constructed <br />thereon a dumpster and trash enclosure approved by the City. <br />1 <br />
