Today went by without incident (the first) so <br />maybe they are planning to address a few of their problems instead of <br />harassing us. <br />As I have heard rumors today about a public hearing I once again want to <br />clarify my position on the gate and wall. I do not approve of the city <br />instituting a public hearing for a modification of either of my PUD's for 30 <br />W. Neal or 55 W. Angela. I consider the design of the gate and wall reviewed <br />and approved by staff. Also please remember that multiple senior staff <br />members, other than Marion Pavan, of all three departments, personally <br />informed me that no approval was necessary for the 6' wall coupled with the <br />fact that to date no examples of "policy" have been produced nor has their <br />been found any language in the municipal code to support another review of <br />the wall. Haps is also afforded a free enclosed service yard and I have now <br />been awarded some relief from their unsanitary conditions, abusive <br />trespassing habits and profane language and gestures .Simply stated the <br />city reviewed my plans over a several day period before approving them and <br />on top of that Mr. Madden and Connors were informed well in advance of the <br />construction with an additional onsite review by them the day that the wall <br />was started with no objections being heard until after completion. <br />Jerry, Haps, Connors and Madden have no legal right, what so ever, to use my <br />land. It is, after all, PRIVATE PROPERTY. The use of the gate for Pleasanton <br />Garbage's access to the Haps dumpsters is at our sole discretion. Please <br />remember that Mr. McColm at 350 main street has garbage pickups every <br />morning with multi 90-gallon containers at the curb for which a similar <br />available service from Pleasanton Garbage would accommodate Haps with no <br />impact on the downtown. <br />Should staff proceed with a hearing, and even though I have made this <br />request on other occasions, I want to be clear it is essential that the Haps <br />1997 conditions of approval be up for review at the same time to avoid <br />prejudice against all of the surrounding properties. If there is a form to <br />sign or a fee to pay please let me know as we all feel it would be a good <br />idea if they are unable to straighten up their act on their own. <br />Mitch Pereira <br />9/14/2007 <br />
