6 <br />THE CITY OF <br />j~L~E~S~4NTON® CITY COUNCIL AGENDA REPORT <br />March 4, 2008 <br />Planning and Community Development <br />TITLE: PUD-81-28-05M -CONSIDER AN APPLICATION FOR A MAJOR <br />MODIFICATION TO AN EXISTING PUD DEVELOPMENT PLAN TO <br />CONSIDER WHETHER AN EXISTING, SIX-FOOT TALL MASONRY <br />WALL ALONG A PORTION OF THE WESTERLY PROPERTY LINE <br />BETWEEN PLEASANTON STATION/RAILROAD SQUARE AND HAP'S <br />RESTAURANT SHOULD BE RETAINED OR REMOVED AT 30 WEST <br />NEAL STREET <br />APPLICANT: City of Pleasanton <br />PROPERTY OWNERS: Mitch Pereira, Eric Hoff <br />GENERAL PLAN: Retail/Highway/Service Commercial, Business and <br />Professional Offices; Downtown Specific Plan <br />SPECIFIC PLAN: Downtown Specific Plan -High Density Residential <br />ZONING: PUD (Planned Unit Development) - C - O (Commercial - <br />Office) District and Downtown Revitalization District. <br />SUMMARY <br />At issue is an existing wall constructed along the property line between the Pleasanton <br />Station/Railroad Square developments and Hap's Restaurant in Downtown Pleasanton. <br />The wall was constructed in the summer of 2006 by the property owner of Pleasanton <br />Station after staff incorrectly approved it. The owner of the Hap's Restaurant site <br />informed staff that he did not have an opportunity to comment, and staff determined that <br />a PUD Modification would have been the correct process for such a site improvement. <br />Staff is now bringing the application to the City Council following the unanimous <br />recommendation for approval by the Planning Commission. <br />PLANNING COMMISSION RECOMMENDATION <br />This application was reviewed at the Planning Commission meeting of February 13, <br />2008. After the Commission took testimony, a compromise was achieved which <br />resulted in modified conditions of approval reflecting the above points. The Commission <br />then recommended approval unanimously. <br />
