In response to an inquiry by Commissioner Blank regarding whether he had known the two <br />additions required a permit but proceeded to build them without a permit because of time <br />pressure, Mr. Smith confirmed that had been the case and that they had commenced the <br />construction with permits to follow and had discussed this with his neighbors. <br />Chairperson Fox noted that the project plan of 21 items mainly contained interior items but did <br />not see the roof listed. Ms. Decker noted that it was listed on Item 28. <br />Mr. Smith detailed the background of the outcome of the hearing in April and described the <br />landscaping and other items that have been completed as depicted on the chart. He noted that <br />they sought some privacy for his family and would be adding landscaping at the rear yard deck <br />areas that were not shown on the plans. They did not have any intention to look into the <br />neighbors' yards or houses. <br />Chairperson Fox noted that she would like to see the exterior work completed first. Mr. Smith <br />agreed and noted that was the wish of the neighborhood as well. He noted that the stucco <br />contractor has wanted to finish the stucco work for some time and that the roofer also wants to <br />finish the roofing work. <br />In response to an inquiry by Commissioner O'Connor regarding whether he believed the exterior <br />work could be completed within a month, Mr. Smith believed that would be reasonable. He <br />noted that it would be very important to complete the stucco work before the rainy season. <br />In response to an inquiry by Chairperson Fox regarding the time when work started, Mr. Smith <br />replied that they tried to start closer to 9:00 a.m. rather than 8:00 a.m. in order to be considerate <br />to the neighbors. <br />In response to an inquiry by Commissioner Olson regarding whether financing was in place to <br />complete the project, Mr. Smith confirmed that he still had the original financing secured in <br />March to complete the project. <br />Steve Neef, A&E Design Services, 1774 Old Tower Road, Livermore, noted that he was the <br />project engineer. He wished to emphasize that Mr. Smith was not attempting to deceive the <br />Building and Safety Division and noted that he had been contacted by Mr. Smith whenever he <br />made a modification to the plans. He then did extensive analysis, and both of them had been in <br />contact with the Building and Safety Division; he had also received provisional inspections by <br />the Building and Safety Division from the beginning. Mr. Smith had been told by the Building <br />and Safety Division that he needed to submit plans. As the project went on too long, the <br />Building and Safety Division initiated action against him. He noted that Mr. Smith had not been <br />sneaking around the Building and Safety Division and that everything had been built to Code. <br />He would like to get the permits in order to finish the project. <br />Steve Evans, 6335 Paseo Santa Cruz, noted that he had recently inspected the project and that it <br />would be easy to bring the project to completion. He added that the workmanship was clean and <br />to Code, and nothing must be removed. He had examined the exterior and believed that it may <br />be completed easily in a month, with the exception of sidewalks and planting material.
